PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THIS DOCUMENT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS, INCLUDING DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, AND OBLIGATIONS TO PROVIDE A SAFE WORKING ENVIRONMENT.

Welcome to OctoCare Auto Detailing. These Terms of Service ("Terms", "Agreement") govern the relationship between you ("Customer", "you", "your") and OctoCare Auto Detailing ("Company", "OctoCare", "we", "us", "our") regarding your access to and use of our mobile automotive detailing services, website, applications, and promotional systems.

1Acceptance of Terms

By scheduling an appointment, purchasing a service pack, registering for a membership, or receiving any service from OctoCare, you expressly acknowledge that you have read, understood, and agreed to be legally bound by these Terms of Service. If you do not agree to all provisions within this document, you must not book or receive services from OctoCare.

2Company Information

3Services Offered

OctoCare provides mobile automotive appearance maintenance, reconditioning, protection, and enhancement services, including but not limited to: interior and exterior detailing, paint correction, ceramic coating applications, engine bay purification, odor elimination, fabric protection, headlight restoration, and fleet maintenance ("Services"). The specific scope of any service is defined by the package selected at the time of booking.

4Mobile Service Requirements

As a mobile service provider, OctoCare operates directly at properties provided or authorized by the Customer. It is the Customer's strict responsibility to guarantee that our detailing utility units have legal, unrestricted access to the vehicle on a flat, stable surface where work can be legally and safely performed without violating municipal codes, neighborhood associations, or property management bylaws.

5Customer Responsibilities

The Customer must ensure that the vehicle is unlocked, fully accessible, and clear of all obstacles at the appointed hour. The Customer must also ensure that the workspace is clear of third-party foot traffic, children, and unsecured hazards. If our service technicians determine the location is unsafe or structurally deficient, service will be deferred, and a trip fee will apply.

6Appointment Scheduling

Appointments must be scheduled via our online platform, authorized mobile application, or through an official telephone representative. All bookings are subject to service professional availability and operational coverage limitations. Bookings are only finalized once an official electronic confirmation via email or SMS text is dispatched by OctoCare.

7Rescheduling Policy

Customers may request to reschedule an appointment up to twenty-four (24) hours prior to the scheduled start time without penalty. Rescheduling requests submitted less than 24 hours before the appointment window may incur an administrative rescheduling fee of up to fifty dollars ($50.00) to account for dispatch adjustments and lost scheduling velocity.

8Cancellation Policy

OctoCare enforces a strict twenty-four (24) hour cancellation policy. If a booking is canceled within less than 24 hours of the established arrival window, or if the customer fails to appear or provide vehicle access within the arrival timeframe, the Customer agrees to forfeit their initial deposit or pay a flat cancellation fee equal to fifty percent (50%) of the projected package cost.

9Late Arrival Policy

Our mobile units utilize standard operational windows due to the unpredictable nature of traffic, transit, and prior project complexity. We allocate an arrival window of up to thirty (30) minutes. In cases where the technician is delayed due to an unforeseen event, we will communicate the updated timeframe. If the Customer is late or unreachable for more than fifteen (15) minutes after arrival, the appointment will be deemed a non-access cancellation.

10Vehicle Access Requirements

The Customer must supply keys, keyless entry fobs, or clear structural authorization necessary to unlock, start, open all doors/compartments, and move the vehicle as needed. By booking a service, the Customer explicitly authorizes OctoCare employees, independent contractors, and agents to operate the vehicle only when necessary to perform detailing, move it short distances within the property, or access service areas.

11Pricing and Estimates

All prices displayed on our website, advertisements, or initial digital selection tools are designated as base baseline starting prices. Final pricing varies dynamically based on vehicle classification size, structural surface condition, severity of interior/exterior contamination, presence of pet hair, advanced biological stains, severe environmental fallout, or other out-of-scope factors determined upon physical inspection by the technician.

12Additional Charges

Should a vehicle present conditions exceeding standard thresholds (e.g., heavy mold, extensive sand saturation, deep biological material, heavy biological matter, extreme mineral scaling), the detailing technician will notify the Customer of necessary surcharges before commencing work. The Customer's explicit verbal or electronic approval of updated pricing is required to continue out-of-scope detailing work.

13Payment Terms

Full payment for all provided services is due immediately upon structural completion of the detail and prior to the technician leaving the site. We accept major credit cards, verified electronic payment links, and approved corporate checks. OctoCare reserves the legal right to retain physical keys or pause service execution if verified payment cannot be immediately facilitated.

14Deposits

To preserve operational slots, specific multi-stage detailing packages, ceramic coating enhancements, fleet projects, or high-demand time slots require a non-refundable scheduling deposit. This deposit will be credited toward the final balance due at service completion, subject to compliance with our cancellation and rescheduling policies.

15Refund Policy

All sales are final. Because our operations involve custom, localized physical labor, material consumption, and time, refunds are not guaranteed simply because a customer changes their mind after the service is completed. Any financial adjustment, credit, or partial restitution is decided at the sole discretion of OctoCare management.

16Satisfaction Policy

We take pride in our precision. If a Customer is dissatisfied with a specific component of our work, OctoCare must be notified within twenty-four (24) hours of service completion. The Customer agrees that OctoCare will be given a reasonable opportunity to physically inspect the vehicle and, if appropriate, re-perform the affected portion of the service to rectify the deficiency before any refund or credit is considered.

17Service Limitations

Mobile detailing is limited by environmental variables, available surface space, lighting, and weather conditions. While our technicians use high-quality commercial tools, certain defects such as deeply embedded stains, deep clear coat scratches, plastic degradation, headliner separation, and persistent interior odors may not be completely rectifiable within standard parameters.

18Existing Vehicle Damage

OctoCare is not responsible for pre-existing damage, including but not limited to: chipped paint, structural rust, oxidation, cracked windshields, clear coat failure, torn leather stitching, warped trim, delicate electronics, or loose interior clips. Technicians perform a pre-service inspection to document structural issues; however, any damage discovered during cleaning that stems from underlying wear is the Customer's responsibility.

19Paint Condition Disclaimer

Vehicles with thin, oxidized, re-sprayed, or structurally degraded paint layers carry risks during mechanical compounding and polishing stages. While we use professional paint thickness measuring techniques where appropriate, the Customer assumes all risks associated with paint correction on compromised factory clear coats or aftermarket finishes.

20Interior Condition Disclaimer

Deep interior cleaning involves steam, extraction liquids, and tailored chemical agents. OctoCare is not liable for structural degradation of aged, UV-damaged, or brittle components such as dashboards, door cards, roof headliners, or pre-weakened electronics that may fracture or fail during standard, careful cleaning procedures.

21Biohazard and Hazardous Material Policy

OctoCare technicians are not licensed biohazard remediation specialists. We do not handle severe biological contamination, including blood, feces, urine, heavy mold infestations, or chemical spills, unless specifically agreed upon in writing under a specialized decontamination tier. We reserve the right to cancel or halt service if undocumented biohazards are discovered, subject to a diagnostic fee.

22Pet Hair Policy

Removing embedded pet hair requires specialized tools, manual agitation, and extended processing times. Standard packages do not cover extensive pet hair removal. An additional pet hair fee will be calculated based on severity. While we strive for near-complete extraction, complete 100% hair removal cannot be guaranteed due to fabric weave variations.

23Excessive Dirt and Sand Policy

Vehicles used for off-roading, beach transport, or construction work often accumulate excessive sand, mud, and grit. These materials embed deeply into carpets and mechanical channels. Removing this debris requires extensive labor and extra equipment wear, and will incur additional fees based on the extra time needed to clean the vehicle.

24Ceramic Coating Disclaimer

Ceramic coating results, longevity, and performance depend on proper maintenance after application. The Customer must strictly follow post-care wash guidelines and avoid automatic abrasive car washes. Failure to maintain the coating properly or use recommended maintenance products will void any operational satisfaction assurances or installation warranties provided by OctoCare.

25Engine Bay Cleaning Disclaimer

Engine bay detailing involves degreasing and low-pressure rinsing of structural mechanical components. The Customer agrees that engine bay cleaning is performed at their own risk. OctoCare is not liable for electrical failures, alternator damage, sensor issues, or starting difficulties resulting from moisture exposure in worn, aged, or poorly sealed engine components.

26Water and Electricity Requirements

While our mobile units are typically equipped with onboard water storage tanks and power generators, certain situations or restricted locations may require the use of the Customer's utilities (e.g., standard 120V electrical outlets or outdoor water spigots). The Customer agrees to grant reasonable access to these utilities if requested or required by specific site conditions.

27Weather Policy

To ensure high-quality results and technician safety, appointments may be rescheduled due to inclement weather, high winds, freezing temperatures, or unsafe outdoor conditions. OctoCare reserves the right to postpone and reschedule services to the next available date without any financial penalty to the company or the Customer.

28Photography Permission

The Customer grants OctoCare full permission to take digital photographs and video recordings of the vehicle's interior and exterior before, during, and after service completion. These media assets are collected for quality assurance, structural verification, and protection against false property damage claims.

29Marketing Use of Photos

Unless explicitly revoked by the Customer in writing prior to service commencement, the Customer agrees that OctoCare may use these images and video assets for marketing, social media portfolios, website galleries, and general advertising. We will make reasonable efforts to blur or obscure license plates and highly sensitive personal identifiers.

30Customer Property Disclaimer

CUSTOMERS MUST REMOVE ALL VALUABLES BEFORE SERVICE. OctoCare is not responsible for any personal items left inside the vehicle, including electronics, jewelry, cash, sunglasses, tools, car seats, or documents. Our technicians will consolidate loose items into a single container but will not be held liable for perceived missing items.

31Lost or Damaged Personal Items

If a Customer suspects an item was lost or damaged during detailing, a formal report must be submitted to OctoCare within twenty-four (24) hours of service completion. OctoCare's total liability for proven lost or damaged personal property is strictly limited to the direct replacement value of the items, up to a maximum cap of one hundred dollars ($100.00).

32Warranty Disclaimer

EXCEPT AS EXPRESSLY PROVIDED OTHERWISE, ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. OCTOCARE DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT REGARDING SERVICE OUTCOMES.

33Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OCTOCARE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF USE, OR PROPERTY DAMAGE ARISING OUT OF OR ENTIRELY CONNECTED WITH OUR MOBILE SERVICES, REGARDLESS OF THE LEGAL THEORY ADVANCED.

34Indemnification

The Customer agrees to defend, indemnify, and hold harmless OctoCare and its sub-contractors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from the Customer's breach of these terms, illegal vehicle placement, or misrepresentation of vehicle ownership.

35Intellectual Property

All brand content, digital logos, vector artwork, character mascot assets, typography styling, custom website text, functional software, and marketing elements are the exclusive intellectual property of OctoCare. No customer or third-party entity is granted any structural license or usage rights without our explicit written consent.

36Referral Program Terms

OctoCare may offer client referral programs. Referral rewards, account credits, or service discounts are earned only after the referred new customer completes their first qualifying detailing service and processes full payment. Promotional referral rewards, payouts, and structures may be modified, adapted, or completely discontinued at any time without prior notice.

37Membership Program Terms

Recurring detailing memberships or maintenance plans are subject to automated recurring billing cycles. Memberships may be canceled subject to the specific duration commitments defined at sign-up. OctoCare reserves the right to modify monthly pricing, adjust slot prioritization, or discontinue membership programs at its sole discretion upon providing thirty (30) days' notice.

38Promotional Offers

From time to time, we may distribute promotional discount codes, holiday vouchers, or seasonal service bundles. All promotional offers are non-transferable, cannot be combined with other discounts or memberships, have no cash value, and may be modified or discontinued at any time by OctoCare management without prior liability.

39Gift Card Terms

Gift cards issued by OctoCare must be redeemed solely for qualifying mobile detailing services within our defined geographical service territories. Gift cards are non-refundable, cannot be exchanged for cash, and do not expire unless prohibited by governing local state law. Lost or stolen cards will not be replaced.

40Privacy

OctoCare collects customer names, addresses, phone numbers, vehicle specifications, and payment details to execute services and process transactions. We treat your personal data with high administrative security and confidentiality. We do not sell your personal data to third-party data brokers. 41Electronic Communications

By providing your phone number and email address, you grant express consent to receive operational alerts, schedule reminders, satisfaction surveys, and occasional marketing dispatches via text messages, automated SMS systems, or electronic emails. You may opt out of promotional messages at any time by replying "STOP" or clicking unsubscribe.

42Governing Law

These Terms of Service and any transactional disputes arising out of our mobile detailing operations shall be governed by and construed in strict accordance with the internal laws of the State in which services were performed, without giving effect to any choice of law or conflict principles.

43Dispute Resolution

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled exclusively through binding, individual arbitration rather than in a court of law. Both parties waive their right to participate in a class-action lawsuit or class-wide arbitration.

44Changes to Terms

OctoCare reserves the right, in its sole discretion, to modify, update, or replace these Terms of Service at any time. The most current version will always be posted on our digital platform. Your continued booking or receipt of services following the publication of changes constitutes firm acceptance of those modifications.
